TERMS & CONDITIONS OF ENTRY
 
  1. Information on how to enter forms part of these Conditions of Entry. Submission of an entry into this Promotion signifies acceptance of these Conditions. Entries not completed in accordance with these Conditions are invalid.

  2. Entry is open to all Australian residents except directors, management and employees of the Promoter and the agencies or companies associated with this Promotion (and their immediate families).

  3. The Promotion commences at 12.01am [EST] on 06.11.06 and closes last mail received on 17.12.06 (the Promotion Period).

  4. To enter, entrants must: a) Purchase any 2 products from the Nabisco In A Biskit range from a participating Woolworths or Safeway store (each a Product) during the Promotion Period; b) complete an original entry form (which can be obtained from participating Woolworths and Safeway stores); and c) mail the completed entry form together with the original barcodes from each of the 2 purchased Products to “WIN with In A Biskit”, PO Box 3173, Narellan DC NSW 2567. Entries must be received by the Promoter during the Promotion Period. Illegible, late or incomplete entries will be invalid and therefore ineligible to enter the Promotion or win a Prize.

  5. Entrants may enter as many times as they like, provided each entry complies with these Conditions and is based on the separate purchase of 2 Products during the Promotion Period. Entrants must retain their original purchase receipts to verify each entry. The Promoter reserves the right to verify the validity of entries and the identity and address of winners, by requesting winners to provide suitable identification and the original proof of purchase receipts from the participating Woolworths or Safeway stores. The Promoter reserves the right to disqualify any entrant for failure to comply with the terms in good faith.

  6. All eligible entries will go into the draw to win a Prize. The draw will take place at 12.00pm [EST] on 19.12.06 at 70 Topham Road, Smeaton Grange, Narellan DC NSW 2567. The Promoter accepts no responsibility for any late, lost, incomplete, misdirected, incorrectly submitted, delayed or illegible entries, claims or correspondence whether due to error, omission, alteration, tampering, theft, destruction or otherwise. Winners will be notified by mail. The Major Prize winner will be sent a notification by mail within two days of the draw and winners' names will be published in The Australian on 22.12.06. The judge’s decision is final and no correspondence will be entered into.

  7. The Promoter may conduct such further draws, at the same place as the original draw, as are necessary on 20.03.07 at 12.00pm EST in order to distribute any Prizes unclaimed (or invalidly claimed) by that date, subject to any written directions given under Reg 37 of the Lottery and Gaming Regulations 1993 (SA) and, where applicable, winners’ names will be published in The Australian on 23.03.07 and winners will be sent a notification in writing within two days of the draw.

  8. There is one (1) Major Prize and one hundred (100) Secondary Prizes to be won. The first valid entry drawn will win the Major Prize. The next one hundred valid entries drawn will each win a Secondary Prize.

  9. The Major Prize is a suitcase, a non-negotiable cheque drawn by the Promoter in the sum of $20,000 made out to the Winner and four economy class round-the-world airline tickets. The total value of the Major Prize is $30,000 [including GST]. Each Secondary Prize comprises a Travel Pack (a small backpack) valued at $25, together with a Woolworths/Safeway gift voucher to the value of $100. The total value of the Secondary Prizes is $12,500 [including GST]. The total prize pool is valued at $42,500 [including GST]. The Woolworths/Safeway gift vouchers are subject to their own terms and conditions of use and by entering this Promotion, entrants acknowledge and accept that they will comply with those terms and conditions. The prizes will be sent by mail to the Winners within 28 days of notification.

  10. The round-the-world airline tickets forming part of the Major Prize must be taken within 12 months of the prize draw. The economy class round-the-world airline tickets will be booked by the Promoter on behalf of the Winner and their nominated travel companions. Subject to flight and destination availability, and the airline carrier's terms and conditions attaching to the round-the-world tickets, they will include 3 stop-overs of the Winner’s choice. All expenses incurred during the use of the round-the-world tickets are the responsibility of the Winner and his or her travel companions, including (but not limited to) transfer charges, accommodation, insurance, meals and all other incidental travel costs.

  11. The Promoter will not book flights to destinations which are described in any way as being destinations which are unsafe, or which should be avoided, by the Australian Government Department of Foreign Affairs and Trade.

  12. All Prize winners (and their travel companions in the case of the Major Prize Winner) agree to voluntarily participate, at the Promoter’s request, in all promotional activities (including publicity and photography-based activities) related to the Promotion and consent to the Promoter using their name and any images of them obtained in relation to the Promotion, in future promotional materials used by the Promoter.

  13. If the Winner of a Prize is under the age of 18 years as at the closing date of the Promotion, the Prize may, in the absolute discretion of the Promoter, be awarded to the Winner’s parent or guardian.

  14. Winners acknowledge and accept (and in the case of the Major Prize Winner, the Winner's travel companions must acknowledge and accept) that to the extent permitted by law the Promoter and its associated agencies and companies will not be liable (whether such liability is said to arise through statute, contract, negligence or other means) for any loss, expense, damage, personal injury or death (including, without limitation, indirect, special or consequential loss or loss of profits), which may be suffered or sustained in connection with this Promotion, by accepting or using any Prize, or by any act or omission of the Promoter and its associated agencies and companies. The Winner of the Major Prize acknowledges that he or she, and each of their travel companions, will be required to sign the letter of indemnity supplied by the Promoter to them, before use of the round-the-world tickets is permitted.

  15. Without limiting the previous paragraph, the Promoter and its associated agencies and companies will not be liable for a Prize being lost or damaged in transit.

  16. The Promoter may, in its sole discretion, disqualify all entries from, and prohibit further participation in this Promotion by, any person who tampers with or benefits from any tampering with the entry process or tampers with the operation of the Promotion or acts in violation of these conditions, acts in a disruptive manner or acts with the intent to annoy, abuse, threaten or harass any other person.

  17. All Prizes and individual elements of Prizes are non-transferable and cannot be exchanged or redeemed for cash. If, for any reason, a Winner does not take an element of the Prize at the time stipulated by the Promoter then that element of the Prize will be forfeited by the Winner. The Promoter accepts no responsibility for any variation in Prize value. Where a Prize is unavailable for any reason, the Promoter reserves the right to substitute for that Prize another item of equal or higher value as determined by the Promoter in its discretion, subject to the approval of the relevant gaming authorities in each state and territory, if so required.

  18. If for any reason any aspect of this Promotion is not capable of running as planned, including by reason of tampering, unauthorised intervention, fraud or any cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter may in its sole discretion cancel, terminate, modify or suspend the Promotion, or invalidate any affected entries, subject to the approval of the relevant gaming authorities in each state and territory, where required.

  19. The Promoter accepts no responsibility for any tax implications for individual winners which may arise from the Prize winnings. Independent financial and/or taxation advice that should be sought.

  20. All entries become the property of the Promoter. The information provided by entrants will be used by the Promoter for the purpose of conducting this Promotion and the promotional purposes outlined in clause 12 above. The Promoter may disclose entrants’ personal information to its contractors and agents to assist in conducting this Promotion or communicating with entrants and to State and Territory gaming authorities where required to do so. Winners’ names may be published as required under the relevant legislation. The Promoter is bound by the National Privacy Principles in the Privacy Act 1988 (Cth) which gives certain rights of access to individuals whose information is held by the Promoter. If information is required and not provided the entry will be invalid. Entrants can access and correct the personal information held about them by the Promoter by writing to "The Privacy Officer", at the address listed below.
